Your access/visit to this website, as well as the purchase of our products and the use of the services offered through this website are subject to the Terms and Conditions of Use, imply your explicit acceptance of them and represent the entire understanding between the parties, in the absence of another contract in this regard. PROPERTY MANAGEMENT CONSULTANT SRL, as administrator of the website www.pmcforma.ro and author of its content, reserves the right to change and update at any time the content of this website, as well as the Privacy Policy and the Terms and Conditions of Use, without any prior notice. Our company is entitled PROPERTY MANAGEMENT CONSULTANT SRL, being a Romanian legal entity, headquartered in the Municipality of Cluj-Napoca, Str. Wolfgang Amadeus Mozart, no. 16, Cluj County, registered with the Trade Register Office under no. J12/2366/2021, Unique Registration Code 44278140 (hereinafter also referred to as "PMC").

  1. Definitions

User: the site visitor/client/potential client (natural person over 18 years of age or legal entity) who accesses and uses the sitewww.pmcforma.roin order to purchase PMC products and/or benefit from the interior design/property management services offered by PMC.

PMC does not sell products and/or services to be purchased by minors. If you are a minor and access a Site/application, you may do so only if you are under the supervision of a parent or legal guardian.

Products: any furniture, flooring, wall coverings, acoustics, lighting fixtures, which correspond to the description on the Site and which are to be provided by PMC to the client following the subsequent conclusion of a contract.

Services: any interior design, consulting, fit-out, maintenance, obtaining permits, property management services to be provided by PMC to the client following the subsequent conclusion of a contract.

Request for an offer: An electronic document that acts as a form of communication between PMC and the client through which the client transmits to PMC the intention to purchase one or more Goods offered by PMC/services provided by PMC and to make payment for them, in compliance with these Terms and Conditions.

Contractual partners: legal entities with which the PMC company concludes commercial agreements for the purchase of products and/or services necessary for the conduct of its activity.

Device: any internet-connected device, such as a phone, tablet, computer or any other device that can be used to visit the PMC Site.

The terms and conditions presented are valid and apply to all pages of the site in the domainwww.pmcforma.ro, for which PMC is the author and administrator. All these pages (as they currently exist or will be subsequently implemented) as well as the websitewww.pmcforma.ro  will be referred to generically, individually or collectively as the "Site" hereinafter.

In the event of using a link to navigate from the Site to another website, PMC's "Terms and Conditions" are no longer applicable. Browsing and interaction on any other website, including those that have a link on the Site, are subject to the rules and policies of the website in question. Thus, third parties may use their own cookies or other methods to collect information about you, PMC being not responsible for their own rules and policies.

By using the Site you expressly accept and agree to the PMC "Terms and Conditions".

PMC is the administrator of the Site and benefits from all legal rights recognized to authors, according to Romanian and international legislation. Unless otherwise specified, all materials, including images, illustrations, designs, icons, photographs, audio/video clips, etc. are either the property of PMC or the property of PMC's contractual partners, PMC having a right of use over them.

The content of the Site, in whole and/or in part, may not be reproduced, duplicated, copied, resold, visited or exploited for commercial purposes without the prior written consent of PMC.

PMC reserves the right to modify, suspend or discontinue, temporarily or permanently, the Site or any service to which it connects, with or without prior notice and without being liable for any damages caused.

  • Terms of use

The Site is provided by PMC on an “as is” and “as available” basis. PMC does not warrant that the Site, the servers on which it is hosted, or emails sent from it will be  www.pmcforma.roare free of viruses or other potentially harmful computer components.

The User uses the Site at his own risk, PMC being free from any liability for any direct or indirect damages caused by the use or access/visit of the Site or as a result of the use of the information on the Site.

PMC is not responsible and does not provide any guarantee regarding accessing sites owned and managed by third parties, even ifwww.pmcforma.roprovides information about them, as they belong to partners of PMC. Any site/application belonging to other people is completely independent of this Site and you assume the taking of all protective measures when accessing those sites/applications without the possibility of holding PMC liable for any damage suffered due to accessing them.

No oral advice or written information given by PMC or any of its affiliates, employees, officers, directors, agents or the like shall create any warranty.

 

  1. Policy for requesting an online offer for the purchase of products and/or the provision of services by PMC

Users can request offers regarding the products sold by PMC and the services provided by PMC through the form available on the Site. The User will select the desired product/service, and then click on the "Request offer!" button, completing the mandatory fields in the form with the following information: the User's first and last name, valid e-mail address, valid phone number and a message regarding the User's request.

Before submitting the form to PMC, the User must check the box "I have read and agree to the Terms and Conditions and Privacy Policy", thus confirming their acknowledgment and acceptance.

The User is responsible for providing all of the aforementioned information completely and accurately. PMC assumes no liability for errors, delays, lack of communication or other consequences caused by incorrect, incomplete or inaccurate information provided by the User.

By launching a request for quotation on the Site, the User agrees to the form of communication (e-mail, SMS, telephone) through which PMC carries out its operations on the Site.

After registering the request for a quote, a representative of PMC will send the User by e-mail (to the e-mail address indicated by the User in the form) or by telephone (to the number indicated by the User in the form) an offer regarding the product/service requested by the User within 3 - 15 days from the moment of registering the User's request, depending on the complexity of the request. The offer sent will include: the requested products and/or services with the relevant specifications, the unit and total price of the products and/or services, the validity period of the offer as well as other relevant information including but not limited to transportation, handling, assembly costs, etc. 

All products displayed on the PMC Site are offered subject to stock availability at the time of the quote request. PMC makes all reasonable efforts to keep product availability information up-to-date, but cannot guarantee that every product listed will be available at all times in any quantity.

PMC reserves the right to refuse to submit an offer in the following cases:

  • The information provided by the User in the offer request form is incomplete, incorrect or inaccurate;
  • Failure to comply with these Terms and Conditions by the User.

PMC assumes no liability for losses and delays that may result from external factors such as technical problems, communication errors or lack of response from the User. 

PMC reserves the right to modify the offer submitted prior to its acceptance by the User for justified reasons, including, but not limited to, price fluctuations from suppliers/certain contractual partners, unavailability of products and/or services, etc.

The offer is valid for the period explicitly specified in the submitted document. After the expiration of the specified period, the offer is considered null and void, and the client will have to request a new offer, following the same procedure described above.

The user can accept the offer sent by PMC within the validity period of the offer mentioned in the document by sending an e-mail to the addressoffice@pmcforma.ro. After receiving the confirmation of acceptance from the User, a representative of PMC will prepare and send to the User a draft of the related sales-purchase/services contract, depending on the products and/or services included in the offer, within 15 days from the moment of receiving the confirmation. The contract will be sent electronically to the e-mail address indicated by the client in the form. The contract will be considered concluded between the parties if, following the negotiations, the parties reach an agreement on all contractual terms and conditions.

For clarity, the submission of a request for a quote for a specific product/service, respectively the submission of an offer from PMC, does not create contractual obligations for either Party, even if the offer from PMC was subsequently accepted by the User. The Parties' obligations will arise only later, upon the conclusion of a separate contract between PMC and the client if, following negotiations, the Parties reach an agreement on all contractual terms and conditions.

 

  1. Intellectual property rights

PMC respects the intellectual property rights of others. If you believe that your work has been copied in a manner that infringes on your intellectual property rights, please provide PMC with a notice that includes:

  • physical or electronic signature of the person authorized to represent the owner of the property right;
  • a description of the copyrighted material that you claim has been infringed;
  • an indication of the location on the Site where you believe these rights have been infringed;
  • contact information, including: your name, surname/title, address, telephone number and email address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the rights owner, its agent, or the law, that you are acting in good faith and that you are the rights owner or acting on its behalf.

 

  1. Notifications

In the understanding of the parties, any notification addressed to PMC is validly fulfilled only if it is sent in writing to the following address: Romania, Mun. Cluj-Napoca, Str. Wolfgang Amadeus Mozart, No. 16, Jud. Cluj, by registered letter with acknowledgement of receipt or by e-mail to the address mihai.seles@pmcforma.ro

Verbal notifications will not be taken into account.

 

  1. Legislation

The terms and conditions are subject to Romanian law. In case of dispute, an amicable solution will first be attempted, within 30 working days from the registration of the complaint at the PMC headquarters. If an agreement cannot be reached within the previously specified period, the disputes will be submitted for resolution to the competent courts at the PMC headquarters.

If, for any reason, a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, the remaining provisions will continue to be enforceable. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by an authorized representative of PMC.

 

  • Force majeure.

Force majeure is any external, unpredictable, absolutely invincible and unavoidable event. Contractual liability is removed if the failure to perform the contractual obligation in accordance with or on time is caused by a force majeure event.

  1. Modification of Terms and Conditions
